Welcome to JobTalk.ai ("JobTalk," "we," "our," or "us"). These Terms of Use ("Terms") govern your access to and use of our website, platform, services, applications, and any related offerings (collectively, the "Services"). 1. Acceptance of Terms
By creating an account, accessing, or using JobTalk, you represent that you:

You further represent and warrant that:
- You have obtained all necessary consents and authorizations under applicable laws, including but not limited to the Telephone Consumer Protection Act (TCPA), before uploading, contacting, or initiating communications with any candidate or recipient through the Services.
- You will not use the Services to send unsolicited or unlawful communications (including robocalls, automated texts, or prerecorded/artificial voice messages) without proper consent.
You may not:
- Misuse JobTalk for spam, harassment, fraud, or illegal activities.
- Copy, reverse engineer, or resell our Services.
- Interfere with or disrupt the operation of the Services.
4. Data, Privacy & Consent
- Data Use: By using JobTalk, you grant us the right to process, store, and analyze data you provide (such as candidate information, communications, and job postings) to deliver and improve our Services.
- Compliance with Consent Laws: You are solely responsible for obtaining and maintaining candidate consent for communications sent through the Services, including compliance with TCPA, FCC, GDPR, CCPA, EEOC, or other applicable laws.
- Reliance on User Representations: JobTalk relies on your representation that you have secured all legally required consents and permissions for candidate outreach.
- Privacy Policy: Our Privacy Policy governs how we collect and use information.
5. Intellectual Property
All content, software, trademarks, logos, and materials provided by JobTalk are owned by or licensed to us and protected by intellectual property laws. You may not copy, distribute, or create derivative works without our express written consent. You retain ownership of any content you upload but grant JobTalk a worldwide, non-exclusive, royalty-free license to use it as necessary to operate our Services.
6. Fees and Payment
- Certain features may require payment. By using paid Services, you agree to pay all applicable fees.
- All payments are non-refundable unless required by law.

7. Disclaimers
- "As Is" Services: JobTalk provides the Services on an "as is" and "as available" basis without warranties of any kind, whether express or implied.
- We do not guarantee uninterrupted or error-free operation.
- We disclaim all liability for hiring outcomes, candidate behavior, third-party integrations, or technical issues.
- No Compliance Guarantee: JobTalk does not provide legal advice and makes no warranty that your use of the Services complies with the TCPA or any other law. Compliance is solely your responsibility.
8. Limitation of Liability
To the maximum extent permitted by law:
- JobTalk is not liable for indirect, incidental, consequential, or punitive damages.
- Our total liability for any claim related to the Services will not exceed the greater of: (a) $100 or (b) the fees you paid us in the 3 months preceding the claim.
9. Indemnification
You agree to indemnify, defend, and hold harmless JobTalk, its affiliates, and employees against any claims, liabilities, damages, penalties, fines, or expenses (including legal fees) arising from:
- Your misuse of the Services.
- Your violation of these Terms or applicable laws.
- Your failure to comply with TCPA, FCC, GDPR, CCPA, or other consent/communication requirements.
- Your handling of candidate data.
10. Termination
- You may stop using JobTalk at any time.
- We may suspend or terminate your access immediately for any violation of these Terms, non-payment, or misuse of the Services.
- Upon termination, provisions regarding Intellectual Property, Disclaimers, Limitation of Liability, and Indemnification will survive.
11. Third-Party Services
JobTalk may integrate with third-party tools (e.g., ATS, CRMs, messaging providers). We are not responsible for their services, actions, or data handling.
12. Governing Law and Disputes
- These Terms are governed by the laws of the State of New Jersey, without regard to conflict of law principles.
- Any disputes must be resolved exclusively in state or federal courts located in New Jersey.
- You waive any right to participate in class actions or jury trials.
- Arbitration (Optional): JobTalk may require that disputes be resolved by binding arbitration instead of court litigation.
